Michigan Sales Tax License: Free Registration Through Michigan Treasury Online
Michigan Sales Tax License: Free Registration Through Michigan Treasury Online
If you make retail sales to customers in Michigan, you will likely need a Michigan sales tax license. The license costs nothing. The Michigan Department of Treasury issues it as a tax registration, and you can apply online through Michigan Treasury Online in one sitting. This guide covers who needs the license, who does not, how to register, when you can start selling, and what the license does not cover.
Disclaimer: This is informational content, not legal or tax advice. Sales tax rules depend on what you sell, who you sell to, and where you do business. For complex situations, talk with a qualified attorney or CPA, and confirm current requirements directly with the Michigan Department of Treasury.
What the Michigan Sales Tax License Is
The Michigan sales tax license is the registration that lets you collect state sales tax from retail customers and report that tax to Treasury. Business owners search for it under several names: michigan sales tax registration, michigan sales tax permit, and michigan seller's permit. Treasury's own term is sales tax license, so use that name when you apply and when you talk with Treasury staff.
Two points to keep straight. First, the license is a tax registration, not a general business license. Michigan does not issue a single statewide business license, as explained later in this guide. Second, the license is free. Michigan charges no fee to register.
Who Must Register
Retailers that make taxable retail sales in Michigan must register with Treasury for a sales tax license. Register before you make your first retail sale, even if you run the business from home, sell online, or sell at events and markets. Whether a particular product or service is taxable is a separate question. Confirm the taxability of what you sell with Treasury or a tax professional before you assume you owe or don't owe tax on it.
Who Does Not Need a Sales Tax License
- Contractors and subcontractors. When you install materials into real property, you are the final consumer of those materials. Contractors and subcontractors do not need a sales tax license for that work.
- Wholesalers selling only for resale. If every sale you make is for resale, you are not required to register. If you also make retail sales to end consumers, you must register for those sales.
If your situation mixes these categories, such as a contractor who also sells products over the counter, get a written answer from Treasury or a CPA before you assume the exemption covers everything.
What It Costs and the Tax Rates
There is no fee for the Michigan sales tax license. The cost to you is the sales tax you collect and remit on taxable sales. Use these rates:
| Item | Rate or Rule |
|---|---|
| Registration fee | None (free) |
| Standard state sales tax rate | 6% |
| Residential electricity, natural gas, and home heating fuel | 4% |
| Local (city or county) sales tax | Not allowed. Michigan does not let cities or counties add a local sales tax. |
Because the state is the only sales tax authority, you do not register with separate city or county sales tax offices. Local governments still have their own licensing and permit rules, covered below.
How to Register Online Through Michigan Treasury Online
Online business registration through Michigan Treasury Online is the fastest route. Work through these steps:
- Gather your business details. Have your legal business name, business address, and the names of your owners or officers ready. If you formed an LLC or corporation, have that information in front of you as well.
- Open the online business registration page. Start at the Treasury page linked above and choose the option to register for a sales tax license.
- Complete the application. The portal lists the fields it requires. Answer each one completely, because a mismatch between your registration and your business records can slow the process.
- Submit and save your confirmation. Keep a copy of the confirmation with your business records.
- Wait for the license. Treasury can issue the license in as little as 7 business days. Plan around that window before your launch date.
Registering on Paper With Form 518
You may also register on paper using Form 518. Use the paper route if you cannot complete the online application. This guide does not state a processing time for paper forms, so confirm with Treasury how long a paper application takes before you plan a launch date around it.
Can You Start Selling Before the License Arrives?
Yes, you may begin selling before the license arrives. The license does not have to be in hand first. However, you must remit sales tax from your first retail sale. A pending application does not delay the tax obligation. Track every taxable sale from day one, including the tax you collected, so your first return is accurate.
How Long the License Lasts
The Michigan sales tax license is valid from January 1 through December 31. Build your calendar around the calendar year, not the date you registered. Confirm with Treasury how renewal works for the following year before December 31, so your registration does not lapse while you are still selling.
Out-of-State Sellers
A seller based outside Michigan can still have to register. An out-of-state seller has nexus, which means it must register, when it made over $100,000 of gross sales or 200 or more separate transactions with Michigan customers in the previous calendar year. Measure both thresholds over the prior calendar year, and track them carefully if you sell online. If you are close to either threshold, ask Treasury or a tax professional how to count your sales.
A Sales Tax License Is Not a General Business License
Michigan has no general statewide business license. The Corporations Division of the Michigan Department of Licensing and Regulatory Affairs (LARA) receives, reviews, and files the documents that form and maintain business entities. It does not license businesses. Registering an LLC or corporation through the MiBusiness Registry is a filing, not a license.
Licensing in Michigan is organized by trade or activity. The agency depends on what you do. Common examples include the LARA Bureau of Professional Licensing, the Bureau of Construction Codes, the Michigan Department of Agriculture and Rural Development (MDARD), the Michigan Liquor Control Commission (MLCC), the Cannabis Regulatory Agency, and LARA child care licensing, among others. LARA's State License Search helps you check whether your business needs one.
Local requirements add another layer. Zoning, certificates of occupancy, and health approvals come from your city, village, township, or county. Michigan has 83 counties, about 275 to 280 cities, about 255 to 258 villages, and 1,240 townships, so the rules that apply to your address matter as much as the state rules. Only 24 cities levy a city income tax, so check your city's rules if you have that question.
Entity Filings Are Separate From the Sales Tax License
If you are forming an entity, that filing is separate from your sales tax registration. An LLC files Articles of Organization (Form CSCL/CD-700) with LARA for a $50 filing fee. The LLC name must include the words Limited Liability Company or the abbreviation L.L.C. or L.C. An LLC must also name a resident agent, the Michigan term for a registered agent, and file an Annual Statement each year. The Annual Statement carries a $25 fee and is due February 15, beginning the year after formation.
Sole proprietors and general partnerships do not file with LARA. They file an assumed name certificate with the county clerk in each county where they do business. County fees for sole proprietors are set by statute and by each county clerk, so confirm the amount with the clerk's office.
Practical Checklist Before You Sell
- Confirm that you make taxable retail sales, or that you have nexus as an out-of-state seller.
- Register for the sales tax license through Michigan Treasury Online, or on Form 518 if you must file on paper.
- Start tracking sales and tax from your first retail sale, even before the license arrives.
- Charge 6% on taxable sales, or 4% on the covered residential electricity, natural gas, and home heating fuel.
- Confirm your filing schedule and due dates with Treasury so your returns are not late.
- Check your city, village, township, and county for zoning, occupancy, and health approvals.
- Confirm renewal for the next calendar year before December 31.
When to Get Professional Help
Get help from a qualified professional if you sell across state lines, if you sell both wholesale and retail, if you have employees or contractors in several places, or if you are unsure whether a product is taxable. An attorney can advise on your entity and licensing questions. A CPA can help with sales tax collection, filing, and the tax treatment of your sales. The Michigan Small Business Development Center can also help you think through your startup steps.
